1. Acceptance of Terms

By accessing or using MakeInfluencers ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

2. Description of Service

MakeInfluencers provides AI-powered tools for generating synthetic character images, candid-style photos, character variations, motion videos, and related content. All generated content is synthetic and AI-created.

3. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old. We do not knowingly provide the Service to anyone under the age of 18.

4. Use of Real Persons' Likenesses

The Service enables the creation of AI-generated synthetic media. If your use involves the likeness of any real, identifiable person, the following rules apply without exception:

• Consent Required: If you upload images or likenesses of any real, identifiable person, you must have their explicit, documented consent to use their likeness in AI-generated media. You are solely and fully responsible for obtaining and maintaining proof of this consent.
• No Unauthorized Use of Likenesses: You must not use the Service to create content depicting any real person without their knowledge and consent. This applies to public figures, celebrities, private individuals, and minors alike.
• No Impersonation or Deception: You must not use the Service to create content that impersonates any person, or that could reasonably mislead viewers into believing it is authentic footage of a real individual.
• No Deepfakes: The creation of deceptive synthetic media — meaning any AI-generated content intended to mislead viewers about what a real person said, did, or experienced — is strictly prohibited.
• Minors: You must not upload or use images of anyone under 18 under any circumstances.

We reserve the right to request proof of consent at any time. Failure to provide adequate documentation of consent upon request will result in content removal and may result in account termination.

5. Prohibited Content & Conduct

You agree not to use the Service to create, distribute, or facilitate any content that falls under the categories below. The following content and activities are strictly prohibited and will result in immediate account termination:

• Depicts any identifiable real person without their verified, explicit consent.
• Pornographic or sexually explicit content: You may not create, upload, or distribute any pornographic, sexually explicit, or obscene material using the Service. This includes nude imagery, sexual acts, erotica, and any content intended to be sexually arousing.
• Nudity: Generation or upload of nude or semi-nude imagery is prohibited. This includes full nudity, partial nudity, and content that is designed to expose or highlight intimate body parts.
• Child exploitation material (CSAM): Any content depicting, suggesting, or referencing the sexual exploitation of minors is absolutely prohibited. This is a zero-tolerance policy. Violations will be reported to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement authorities.
• Content involving minors: You may not generate, upload, or create any synthetic imagery of individuals who are or appear to be under 18 years of age. This applies to all content, regardless of context or intent.
• Non-consensual intimate imagery: Creating synthetic intimate or sexual imagery of real individuals without their explicit consent is prohibited.
• Harassment and impersonation: Using generated content to harass, bully, defame, threaten, or impersonate real individuals is prohibited.
• Fraud and deception: Using generated content to deceive others in ways that cause harm, including creating fake evidence, fraudulent identity documents, or misleading news content.
• Violence and hate speech: Content that promotes violence, terrorism, or hatred against individuals or groups based on protected characteristics.
• Intellectual property infringement: Content that infringes on any third party's intellectual property rights, privacy rights, or publicity rights.
• Political manipulation and disinformation: Content intended for political manipulation, disinformation campaigns, or propaganda purposes.
• Violation of law: Any content or conduct that violates any applicable local, national, or international law or regulation.

6. Content Moderation

We employ automated content moderation systems to detect and prevent prohibited content. All uploaded and generated content is subject to automated scanning. Content that violates our policies will be blocked, removed, and may result in account suspension or termination. We reserve the right to review any content at any time.

7. User Responsibilities

• You are solely responsible for all content you create, upload, or generate using the Service.
• You must comply with all applicable local, state, national, and international laws and regulations.
• You must not attempt to circumvent, disable, or interfere with content moderation or safety systems.
• You are responsible for maintaining the confidentiality of your account credentials.

8. Intellectual Property

Content you generate using the Service is subject to the following terms: You retain rights to content you create within the bounds of applicable law and our acceptable use policy. You grant us a non-exclusive license to store, process, and moderate your content as needed to provide the Service. We retain all rights to the Service, its technology, and any improvements thereto.

9. Synthetic Content Disclosure

All content generated by the Service is synthetic (AI-generated). You agree to clearly disclose when content created using the Service is AI-generated, particularly when sharing publicly or commercially. Failure to disclose may violate applicable laws in your jurisdiction.

10. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms. In the event of termination for content policy violations, no refunds will be issued for any remaining credits or subscription period.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that generated content will be accurate, appropriate, or free from errors. We are not responsible for how you use generated content or any consequences arising from such use.

12. Limitation of Liability

To the maximum extent permitted by law, MakeInfluencers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted. Continued use of the Service after changes constitutes acceptance of the modified Terms.
